Sometime in April 2008, the Persatuan Penduduk Medan Damansara Kuala Lumpur protested against Jabatan Perancang, DBKL, for granting a Developer Order for a hill slope development involving 21 units of four storey bungalows and swimming pool (just behind Victoria Station) in Medan Damansara. As a result of the protest by the Residents Association, DBKL issued a Stop Work Order to the developer.
Today (Sunday, 22 June 2008) I was invited by the residents of Medan Damansara to attend their meeting at 4 pm. I must commend the said Residents Association for their strong determination to stop this hill slope project and they are making things happened.
On 12 June 2008, Pengarah of Jabatan Pengairan dan Saluran Wilayah Persekutuan wrote a letter to none other then the famous Tuan Haji Mahadi bin Che Ngah, who has been known not to read his sms for 5 days!
These are the important excerpts from the said letter:
“Berdasarkab laporan-laporan dan pelan-pelan yang telah dikemukakan, jabatan ini masih belum dapat memberikan sokongan terhadap permohonan di atas kerana perkara-perkara yang berikut:
a) Pihak perunding ttidak mengemuikakan Pelan Kawalan Hakisan dan Kelodak (ESCP) yang lengkap kerana hanya salinan fotostat, tidak dilorek dengan warna yang sesuai untuk struktur-struktur yang berlainan dan tidak terdapat tandatangan perakuandari Jurutera Profesional pada pelan-pelan berkenaan.
b) Rekabentuk sediment basin tidak memenuhi syarat Garis Panduan MSMA kerana nisbah side slope yang digunakan akan adalah H: V Bersamaan ): 1 (kecerunan 90 degree tifdak boleh diterima).
c) Pihak perunding mengemukakan rekabentuk U-Drain sebagai perangkap kelodak sedangkan cascading U-Drain akan menghasilkan halaju air yang tinggi maka adalah dikhuatiri U Drain tersebut tidak dapat berfungsi sebagai yang direkabentuk.
On 17 June 2008, Pengarah Jabatan Mineral and Geosains, Selangor and Wilayah Persekutuan, wrote a letter to Pengarah JabtanKerja Awam, DBKL.
These are the important excerpts from the said letter:
“Untuk makluman tuan pihak jabatan ini teleah menerima aduan secara bertulis daripada Medan Damansara Resients’ Association melalui surat bertarikh 21 Mei 2008 berhubung kerja tanah yang telah dijalankan oleh pihak pemaju yagn melibatkan pemotongan kawasan kelas IV ataupun yang mempunyai kecerunan melibihi 35 degree. Lanjutyan daripada itu, pemeriksaasn tapak telah dilakukan oleh pihak jabatan ini bersama-sama dengan beberapa orang wakil daripada Medan Damansara Residents Association. Hasil daripada pemeriksaan tapak serta semakan terhadap Construction Suitability Map yang telah dikemukakan terdahulu, pihak jabatan ini mendapati memang benar pihak pemaju telah membuat kerja-kerja pemotongan tanah di kawasan yang mempunyai kecerunan melebihi 35 degree.
Sehubungan itu, pihak jabatan ini ingin member beberapa pandangan serta syor berhubung perkara ini. Berikut adalah pandangan dan syor jabatan ini:
ii. Berhubung dengan perlanggaran syarat yang telah dinyatakan di dlaam ulasan jabatan ini di mana kawasan yang melebihi 35 degree tidak boleh dibangunkan, perkara ini adlah di bawah bidang kuasa pihak DBKL.”
The above two letters were clear evidence that that Pengarah Jabatan Perancang, Tuan Haji Mahadi bin Che Ngah, blindly approved the said project without demanding for the important reports from Jabtan Pengairan dan Saluran dan Jabatan Mineral dan Geosains. Tuan Haji Mahadi bin Che Ngah was extremely efficient to take actions against hawkers but he suffers from willful blindness when developers are involved!
In view of the above known scandalous acts of Tuan Haji Mahadi bin Che Ngah, I believe that they may be other Development Orders for other projects granted by Tuan Haji Mahadi bin Che Ngah under similar circumstances.
I call upon Datuk Bandar to immediately suspend Tuan Haji Mahadi bin Che Ngah from all duties and order for an investigation into all the other Development Orders (especially those involved with Platinum Victory Sdn Bhd) granted by Tuan Haji Mahadi bin Che Ngah.
I shall lodge a report against Tuan Haji Mahadi bin Che Ngah with the Anti-Corruption Agency in due course.

Now we know about Mahadi of Jabatan Perancang. We have to excuse him because he may have forgotten about the policies, rules and everything – just like he had forgotten to read his sms in his phone for 5 days!
This is a clear case for Anti-Corruption Agency to look into because it was too good to be true that he could overlook such important report when approving a hill slope project.
Now that the Pengarah Jabatan Pengairan and Saluran and Jabatan Mineral dan Geosains have openly stated that Jabatan Perancang DBKL did not follow the rules and policies, Mahadi should resign immediately for failing in his duties or be sacked immediately.
YB Wee should lodge a report against Mahadi with ACA. I am sure that Mahadi would love to declare his ASSETS! I am also interested to know about his assets, too!!!
Yes, it is high time that an ACA report should be lodged against Mahadi, the head of Jabatan Perancang, a DBKL department that caused problems to KL residents.
I am certain that ACA can find a lot of questionable approvals for Development Order by Mahadi for residential or commercial project in KL. Of course, Datuk Bandar should be also responsible because he is the CEO and he cannot say that he was not aware of all the Development Orders that has been granted by Mahadi.
YB Wee, please lodge an ACA report against these scandals.
I drive by the the road everyday and just watch the “rape” of the hill. Anyone without “technical” knowledge about land development would know that what they are doing now is courting danger. Obviously they have NOT learnt anything from the Highland Towers tragedy. Profit is the main criteria, afterall life is so cheap nowadays, there’s no value attached to it. When these actions are lodged via police reports, did you not notice that hardly any action is taken or taken at a snail pace. The priorities of the people in power is all wrong!.

I am in full agreement with you. I know that nothing will come out of whatever report lodge with ACA unless BN wants to fix someone.
YB Wee just lodge the report to ACA and let see what Mahadi and Datuk Bandar will react.
Mahadi is famous for helping big time developers. So it is now time for him and Datuk Bandar to sweat.

You are right in your stand. Nothing will happen after the report because BN has no will to act against corruption involving its officer. Mahadi has been known to have been campaigning for Zulhasnan, Minister of Wilayah Persekutuan. So Mahadi can carry on with his “activities” in Jabatan Perancang with impunity.
Mahadi is very close to big time developers in KL. He also gave Development Orders to Platinum Victory Sdn Bhd without proper checking whether the projects have complied with all the policies of DBKL, government and building guidelines and regulations like the Medna Damansara project.
YB please look into the projects by Platinum Victory Sdn Bhd. If you spend a bit of time checking you will find more things about this Mahadi, a smooth operator in Jabatan Perancang. He is alsoa blue boy of Datuk Bandar KL. YOU ALL SHOULD KNOW WHY????

i’m not sure if this “not to read his sms for 5 days!” fella has anything to do with the massive clearing of the hills and forest in Tmn Melawati. I could see that big patch of bare soil from my condo. The area is just behind “21 Trees” in Tmn Melawati.

I am not surprise if Mahadi was involved because he is the head of Jabatan Peracang. He must be sacked and sacked now.
Mahadi must be the man. Can’t be anyone else because he is the head of Jabatan Perancang. The worst department in DBKL which has created problems for the residents in KL.

Mahadi was the same person who took drastic actions against the hawkers in Section 2, Wangsa Maju. Let’s see what will he do about this hill slope project, which did not comply with government policies and regulations.

That Mahadi again. He seems to be the main problem in development in KL. YB Wee why waiting, Just lodge a report with the ACA. Not that ACA will act. Just put on record first and when PR in power open up the file and prosecute this him.
This case shows that there was hanky panky involved in the approval. I am sure that there are more in other approvals for Development Order. Please proceed to lodge an ACA report against this Mahadi.
Surprisingly Datuk Bandar KL is keeping very quiet about this matter. Datuk Bandar is the CEO of DBKL. Therefore, he is accountable for the actions of his subordinates like Mahadi. Datuk Bandar must tell us how this project was approved under such strange circumstances where Jabatan Perancang approved hill slope project against government policies and regulations.
Datuk Bandar must not pretend that all is well with Jabatan Perancang. He must now come out to explain why the Development Order was issued and after protest from the residents, DBKL had to issue a “Stop Work Order”. This was most scandalous!
I call upon Datuk Bandar to explain why the Development Order was allowed to be issued under such circumstances.
YB Wee, you are absolutely right. Press on your demand for Datuk Bandar must explain on what basis Mahadi approved the Development Order.
He can not remain quiet int he hope that it will go away. It will not.
YB Wee should also lodge a report with the ACA against Datuk Bandar also as he is the boss of DBKL and he should also be responsible for Mahadi’s actions

Of course, we all know that he is very close to Platinum Sdn Bhd in Wangsa Maju area. That’s why Platinum got the approval easily.

What do you mean about another scandal? There are many more scandals of Mahadi. I look forward to hear more during the debates in Parliament.
I am certain that YB Wee is not going to spare this little napoleon, who is bullying the poor hawkers and protecting the rich developers.
